This User Agreement (“Agreement”) governs the use of LUNAR smartphone (the “Device”). By setting up, using, or accessing the Device, you accept the terms of this Agreement. Please read it carefully before proceeding.

By opening the package or using the Device, you agree to comply with all terms outlined in this Agreement. If you do not agree to the terms, you must not use the Device and should return it in accordance with the return policy.

LUNAR grants you a limited, non-exclusive, non-transferable license to use the software pre-installed on the Device, as well as any updates provided by LUNAR. You agree not to modify, copy, distribute, or create derivative works of the software except as allowed by applicable law.

LUNAR may offer software updates to enhance the functionality and security of your Device. It is recommended that you install all updates to ensure optimal performance and security.

The Device comes with a limited warranty covering defects in materials and workmanship for a period of 1 year from the original retail purchase in its original packaging. This warranty does not cover accidental damage, misuse, or unauthorized modifications.

To the maximum extent allowed by law, LUNAR is not liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the Device.

You agree not to use the Device in any unlawful manner, or in violation of this Agreement. Unauthorized use of the Device may result in its deactivation without notice.

Any disputes related to this Agreement shall be governed by the laws of Texas. If a dispute arises, you agree to resolve it through binding arbitration, in accordance with the rules of the American Arbitration Association (AAA).

LUNAR may terminate this Agreement or your access to the Device at any time if you violate the terms.

LUNAR reserves the right to update or modify this Agreement at any time. Updates will be communicated through the Device notifications. Continued use of the Device constitutes acceptance of the revised terms.

By setting up and using your LUNAR smartphone, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms.
